These Terms and Conditions (“Terms”) govern your access to and use of GetSuperSnacks.com and any related pages, accounts, subscriptions, gift cards, or purchases (the “Site”).

The Site is operated by Lueberry Superfoods, LLC (“Lueberry,” “Super Snacks,” “we,” “us,” or “our”), doing business as Super Snacks by Lueberry.

By visiting the Site or placing an order, you agree to these Terms, our Privacy Policy, and our Refund Policy. If you do not agree, do not use the Site.

The store is hosted by Shopify Inc., which provides the e-commerce platform we use to sell products to you.

1. Eligibility

You must be the age of majority in your state or province of residence to use the Site or place an order. If you allow a minor dependent to use the Site, you are responsible for their activity.

You may not use the Site or our products for any illegal purpose or in violation of any applicable law.

2. The products

We sell packaged nutrition and energy bars and related merchandise. Product descriptions, nutrition facts, ingredients, allergens, flavors, images, and claims on the Site are for general information.

Always read the label on the package you receive. Packaging is the controlling source for ingredients, allergens, and nutrition.

Bars contain ingredients that may include nuts, peanuts, milk (whey), soy, and other allergens. If you have a food allergy or dietary restriction, review the label before eating.

Our products are foods, not drugs. They are not intended to diagnose, treat, cure, or prevent any disease. Results vary.

Flavor names, protein amounts (including Classic 10g and MAX 25g), collagen, probiotics, sugar content, and other claims describe the product as formulated. We may update recipes, packaging, or formulations.

Colors and photos on screen may not match the product exactly.

We do not guarantee that any product will meet your personal taste or performance expectations.

Offers are void where prohibited.

3. Orders, pricing, and payment

Placing an order is an offer to buy. We may accept, limit, or refuse any order for any reason, including suspected reseller activity, pricing errors, or inventory issues.

Prices, promotions, and shipping charges may change at any time. If we change or cancel an order after you submit it, we will try to notify you using the email, phone, or address you provided.

You agree to provide accurate billing, shipping, and account information and to keep it current.

We may limit quantities per person, household, payment method, or address.

Payment is processed through Shopify and its payment partners. We do not store full credit-card numbers on our own servers.

Title and risk of loss pass to you when we deliver the order to the carrier, except where required otherwise by law.

4. Shipping

We ship to addresses we support at checkout. Delivery dates are estimates, not guarantees.

We are not responsible for delays caused by the carrier, weather, incorrect addresses, or events outside our control. If a package is returned as undeliverable, we may charge you to reship or refund the product amount minus outbound shipping, at our discretion.

Inspect your order when it arrives. If something is damaged, missing, or wrong, contact orders@lueberrysnacks.com promptly with your order number and photos.

5. Returns, refunds, and exchanges

Returns and refunds are governed by our Refund Policy.

In short:

You generally have 30 days after delivery to request a return of eligible unused items in original packaging, with proof of purchase.

Start every return by emailing orders@lueberrysnacks.com. Do not send product back without approval.

Food products that have been opened, eaten, or are no longer in sellable condition generally cannot be returned, except for damaged, defective, or incorrect items we confirm.

Sale items and gift cards are not returnable, except where required by law.

If we approve a refund, it goes back to the original payment method after we receive and inspect the return. Banks can take additional time to post it.

If you received the wrong item or a damaged box, we will make it right. Tell us as soon as you can.

6. Subscriptions

Some products may be offered on a recurring subscription (for example, monthly delivery).

You authorize us to charge the payment method on file for each renewal at the then-current subscription price, plus applicable tax and shipping.

You can skip, reschedule, edit, or cancel future deliveries through your account or by contacting us before the next order processes.

Cancellation stops future shipments. It does not refund orders already processed or shipped.

We may change subscription pricing or contents with notice as required by law.

7. Gift cards

Digital gift cards are delivered by email and are non-refundable except where required by law.

Treat gift-card codes like cash. We are not responsible for lost, stolen, or unauthorized use of a code after delivery.

Gift cards have no cash value except as required by applicable law.

We may refuse or cancel a gift-card purchase if we suspect fraud.

8. Promotions and first-order offers

Promotions, sample packs, discount codes, and “free with first order” offers are subject to their stated rules. One offer per customer unless we say otherwise. We may modify or end a promotion at any time. Offers cannot be combined unless we say they can. We may deny an offer we reasonably believe is being abused.

9. Accounts

You are responsible for your account login and for activity under your account. Notify us if you think someone else is using it. We may suspend or close accounts that violate these Terms.

10. Acceptable use

You may not:

Use the Site for any unlawful purpose

Scrape, harvest, or copy the Site in bulk without our written permission

Interfere with the Site, other users, or our systems

Upload malware or attempt to gain unauthorized access

Impersonate us or anyone else

Resell products purchased on the Site as a dealer or distributor without our written approval (wholesale inquiries go through LueberrySnacks.com)

We may refuse service, terminate accounts, or cancel orders if we believe these Terms were violated.

11. Intellectual property

Lueberry, Super Snacks, Super Snack, related logos, product names, packaging, photos, copy, and site design are owned by us or our licensors. You may not use them without our written permission, except to browse and shop as intended.

If you send us reviews, photos, ideas, or other feedback, you give us a worldwide, royalty-free, perpetual license to use that content in any media, without paying you or keeping it confidential. Do not send anything you do not have the right to share.

12. Third-party links and tools

The Site may link to third-party sites or tools (including Shopify, payment processors, shipping carriers, and social platforms). We do not control those services and are not responsible for them. Their terms and privacy policies apply to your use of them.

13. Disclaimer of warranties

THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, or secure, or that product descriptions are complete, current, or error-free. We may correct errors and cancel affected orders.

Some states do not allow certain warranty limitations. Those limits may not apply to you.

14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LUEBERRY SUPERFOODS, LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR SUBSTITUTE GOODS, ARISING OUT OF THE SITE OR ANY PRODUCT, EVEN IF WE WERE ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR AN ORDER WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE PRODUCTS AT ISSUE IN THE 12 MONTHS BEFORE THE CLAIM.

These limits do not apply to liability that the law does not allow us to limit.

15. Indemnity

You agree to defend and hold us harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, your violation of these Terms, or content you submit.

16. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law rules.

You agree that exclusive venue for any dispute that is not resolved informally will be the state or federal courts located in Fayette County, Kentucky, and you consent to personal jurisdiction there, except where applicable law requires otherwise.

Before filing a claim, email hello@lueberrysnacks.com and give us 30 days to try to resolve it.

17. Changes

We may update these Terms by posting a new version on this page and updating the date above. Continued use of the Site after changes means you accept the revised Terms. The current version is always the one on this page.

18. Other terms

If any part of these Terms is unenforceable, the rest still applies. Our failure to enforce a provision is not a waiver. These Terms, plus the policies linked here, are the entire agreement between you and us about the Site.

Wholesale, retail distribution, and B2B sales are separate from this consumer Site and may be governed by a different agreement.
